Welcome to Crestelligent. These Terms of Service ("Terms") govern your access to and use of the Crestelligent website, application, property listings, search tools, enquiry features, and related services (collectively, the "Platform").

By accessing or using Crestelligent, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, please do not use the Platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a binding agreement to use Crestelligent.

If you use Crestelligent on behalf of a company, partnership, organization, or another person, you represent that you have the authority to accept these Terms on their behalf.

Crestelligent is a real-estate technology platform designed to help users discover, evaluate, search, compare, and enquire about real estate properties.

Depending on the features available, Crestelligent may allow users to:

• View property details, images, pricing, and specifications.
• Review property and financial information.
• Save or compare properties.
• Submit property enquiries.
• Contact property owners, agents, developers, or other listing parties.
• Create and manage property listings, where enabled.
• Access other real-estate-related tools and services provided by Crestelligent.

Unless expressly stated otherwise, Crestelligent is not the owner, seller, purchaser, landlord, tenant, agent, developer, or legal representative of any property listed on the Platform.

3. Property Listings and Information

Property information displayed on Crestelligent may be provided by property owners, agents, developers, partners, public sources, or other third parties.

This information may include:

• Property prices.
• Property size and measurements.
• Number of units.
• Location and address.
• Property type.
• Year built.
• Amenities.
• Images and videos.
• Financial information.
• Availability.
• Ownership or project information.
• Other property-related information.

We make reasonable efforts to provide useful and accurate information. However, Crestelligent does not guarantee that any property listing or information is complete, accurate, current, or error-free.

Prices, availability, property specifications, photographs, financial information, and other listing details may change without notice.

4. No Guarantee of Property Availability

The appearance of a property on Crestelligent does not guarantee that the property:

• Is available for purchase or lease.
• Is available at the displayed price.
• Is available in the displayed configuration.
• Is legally available for transaction.
• Is free from liens, encumbrances, disputes, or other restrictions.

A property listing does not constitute an offer, promise, or guarantee that a transaction will be completed.

Any transaction between users, property owners, agents, developers, or other parties is subject to their own agreements and applicable laws.

5. Due Diligence

You are responsible for conducting your own due diligence before entering into any real-estate transaction.

Depending on the property and transaction, you should independently verify matters including:

• Ownership and title.
• Encumbrances and liens.
• Property measurements.
• Government approvals and permits.
• Building and zoning requirements.
• Occupancy or completion documentation, where applicable.
• Property taxes and outstanding dues.
• Litigation or disputes.
• Seller, landlord, developer, or agent identity.
• Authority of the person offering the property.

Crestelligent recommends obtaining appropriate professional advice, including legal, financial, tax, lending, insurance, or real estate advice, before committing to a transaction.

6. User Accounts

Certain features of Crestelligent may require you to create an account.

You agree to:

• Provide accurate and complete information.
• Keep your account information current.
• Maintain the confidentiality of your login credentials.
• Notify Crestelligent promptly of unauthorized access to your account.
• Not create an account using another person's identity or information.

You are responsible for activity conducted through your account unless caused by circumstances beyond your reasonable control.

7. Property Listings Submitted by Users

Where Crestelligent allows users to create or submit property listings, you represent and warrant that:

• You own the property or have appropriate authorization to list it.
• The information provided is accurate and not misleading.
• You have the necessary rights to upload photographs, videos, documents, descriptions, and other content.
• Your listing does not violate applicable laws or third-party rights.
• You will update the listing when material information changes.

Crestelligent may review, modify, reject, suspend, or remove listings that it reasonably believes violate these Terms, applicable law, or Platform policies.

8. User Content

Users may submit content including photographs, property descriptions, documents, reviews, comments, messages, and other materials ("User Content").

You retain ownership of your User Content. By submitting User Content to Crestelligent, you grant Crestelligent a non-exclusive, worldwide, royalty-free license to host, store, reproduce, display, distribute, and use the content as reasonably necessary to operate, maintain, improve, and promote the Platform.

You are responsible for ensuring that your User Content does not infringe the rights of any person or entity.

9. Prohibited Activities

You must not use Crestelligent to:

• Publish false, fraudulent, or misleading property information.
• List a property without appropriate authority.
• Impersonate another person or organization.
• Harass, threaten, or abuse another user.
• Upload unlawful, defamatory, discriminatory, or infringing content.
• Upload malicious software or harmful code.
• Attempt to gain unauthorized access to the Platform or another user's account.
• Circumvent Platform security or access controls.
• Scrape, crawl, harvest, or systematically collect Platform data without written permission.
• Copy or reproduce Platform content for a competing service.
• Use automated systems or bots in a manner that interferes with the Platform.
• Use contact information obtained through Crestelligent for unrelated spam or abusive marketing.
• Engage in fraudulent transactions or deceptive practices.

10. Fair Housing and Anti-Discrimination

Crestelligent supports equal access to housing and prohibits the use of the Platform in a manner that violates applicable federal, state, or local fair housing and anti-discrimination laws.

Users are responsible for ensuring that their listings, advertisements, communications, and other activities comply with all applicable fair housing and anti-discrimination requirements.

Crestelligent may remove or restrict content that it reasonably believes violates applicable law or Platform policies.

11. Enquiries and Communications

When you submit an enquiry about a property, you authorize Crestelligent to facilitate communication between you and the relevant property owner, agent, developer, or other listing party.

Crestelligent does not guarantee that:

• The recipient will respond.
• The property will remain available.
• The recipient's information is accurate.
• A transaction will occur.
• The enquiry will result in a sale, purchase, lease, financing, or other agreement.

12. Payments and Paid Services

If Crestelligent offers paid services, subscriptions, listing packages, advertising, premium features, or other paid products, additional terms may apply.

Before making a payment, you will be shown the applicable price and relevant payment conditions.

Refunds and cancellations will be handled according to the applicable terms presented at the time of purchase and any rights provided by applicable law.

13. Real Estate and Investment Disclaimer

Information available through Crestelligent is provided for general informational purposes.

Nothing on the Platform constitutes:

• Legal advice.
• Tax advice.
• Financial advice.
• Investment advice.
• A recommendation to purchase or sell a property.
• A guarantee of investment performance.
• A guarantee of future property value.
• A guarantee of financing or loan approval.

Real estate transactions and investments involve financial and other risks. You are responsible for making your own decisions and obtaining professional advice where appropriate.

14. Third-Party Services and Links

Crestelligent may contain links, integrations, or services provided by third parties.

Crestelligent does not control third-party websites or services and is not responsible for their content, availability, security, or policies.

Your use of third-party services may be subject to their own terms and privacy policies.

15. Intellectual Property

The Crestelligent name, brand, logo, Platform, software, design, trademarks, graphics, text, and other original materials are owned by or licensed to Crestelligent, unless otherwise stated.

You may use the Platform only for its intended purposes and in accordance with these Terms.

You may not copy, modify, reproduce, distribute, sell, license, reverse engineer, or create derivative works from Crestelligent or its proprietary content without prior written permission, except where permitted by applicable law.

16. Privacy

17. Platform Availability

Crestelligent aims to keep the Platform available and functioning, but does not guarantee uninterrupted, secure, or error-free operation.

We may temporarily suspend, modify, or discontinue parts of the Platform for maintenance, upgrades, security reasons, technical issues, or other operational requirements.

18. Disclaimer of Warranties

To the maximum extent permitted by applicable law, Crestelligent and its services are provided on an "as is" and "as available" basis.

Crestelligent does not warrant that:

• The Platform will always be available.
• Property listings will always be accurate or current.
• Property information will be complete.
• A listed property will remain available.
• A transaction will be completed.
• The Platform will be free from errors or interruptions.
• Information obtained from third parties will be accurate or reliable.

Nothing in these Terms excludes any rights or protections that cannot lawfully be excluded under applicable law.

19. Limitation of Liability

To the maximum extent permitted by applicable law, Crestelligent will not be responsible for indirect, incidental, special, consequential, or punitive losses arising from or related to:

• Property transactions between users.
• Incorrect or misleading information supplied by third parties.
• Property defects or legal issues.
• Fraud or misconduct by another user.
• Loss of profits or business opportunities.
• Unavailability of a property.
• Changes in property prices.
• Unauthorized conduct of third parties.
• Use or inability to use the Platform.

Nothing in these Terms limits liability where such limitation is prohibited by applicable law.

20. Indemnification

You agree to indemnify and hold harmless Crestelligent, its directors, officers, employees, contractors, affiliates, and service providers from claims, losses, liabilities, damages, costs, and expenses arising from:

• Your violation of these Terms.
• Your misuse of the Platform.
• Your User Content.
• Your violation of another person's rights.
• Your property listing or transaction.
• Your violation of applicable law.

21. Suspension and Termination

Crestelligent may suspend or terminate your access to the Platform if:

• You violate these Terms.
• You provide false or misleading information.
• We reasonably suspect fraudulent or unlawful activity.
• Your use creates a security or legal risk.
• Suspension or termination is required by law or a government authority.

You may stop using Crestelligent at any time.

Termination does not affect provisions that by their nature should continue after termination, including intellectual property, disclaimers, limitations of liability, indemnification, and dispute-related provisions.

22. Changes to These Terms
